SECTION 1: INTRODUCTION & ACCEPTANCE OF TERMS

1.1. Preamble

Welcome to the official website of Indo Aerial Systems Private Limited (hereinafter referred to as “The Company,” “Indo Aerial,” “MK Aero,” “We,” “Us,” or “Our“). We are a drone manufacturing company incorporated under the Companies Act, 2013, with our registered office located in Chennai, Tamil Nadu, India.

Our mission is to revolutionize the Indian drone ecosystem by designing and manufacturing high-quality, affordable Unmanned Aerial Vehicle (UAV) solutions for agriculture, surveying, industrial inspection, defense support, and environmental applications.

1.2. Acceptance

By accessing, browsing, or using this website (www.mkaero.in) and/or purchasing any products (including but not limited to Drone Frames, Propulsion Systems, Flight Controllers, and Accessories), you (“The Customer” or “User“) explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you must immediately discontinue the use of our website and services.

SECTION 2: PRODUCT SPECIFICATIONS & MANUFACTURING DISCLAIMER

1.2. Acceptance

Indo Aerial Systems takes pride in its fully integrated in-house design and manufacturing ecosystem. We utilize state-of-the-art tool rooms to develop prototypes, create production-ready designs, and manufacture mass-production tooling domestically.

  • Material Variability: While we strive for precision, our products (such as Ribbed Aluminum Arms and thermoplastic parts) may exhibit minor cosmetic variations inherent to the manufacturing process. These do not affect structural integrity.
  • Design Improvements: We practice continuous Research & Development (R&D). Consequently, The Company reserves the right to modify product specifications, materials (e.g., switching from carbon fiber to aerospace-grade aluminum), and designs without prior notice to improve performance or durability.

2.2. Product Suitability

Our products are engineering components intended for professional assembly.

  • User Competence: The Customer acknowledges that assembling a drone from kits (e.g., MK Aero 10L Airframe) requires technical expertise in soldering, electronics, and flight dynamics.
  • Compatibility: While our parts are designed to follow industry standards (e.g., 30mm/40mm tubes), The Company does not guarantee compatibility with third-party components not tested by us.

SECTION 3: REGULATORY COMPLIANCE (DGCA & GOVERNMENT OF INDIA)

3.1. Strict Adherence to Law

The operation of Unmanned Aerial Systems (UAS) in India is strictly regulated by the Directorate General of Civil Aviation (DGCA) under the Drone Rules, 2021 (and subsequent amendments).

3.2. Customer Obligations

By purchasing an MK Aero drone or kit, The Customer agrees to:

  1. Registration: Obtain a Unique Identification Number (UIN) for the drone via the Digital Sky Platform before operation.
  2. Licensing: Possess a valid Remote Pilot Certificate (Category: Agriculture/Rotorcraft) if the drone’s weight category requires it.
  3. Flight Restrictions: strictly adhere to “No-Fly Zones” (Red/Yellow zones) and altitude restrictions as mandated by the Ministry of Civil Aviation.

3.3. Indemnification Against Unlawful Use

Indo Aerial Systems Pvt. Ltd. is a manufacturer of hardware only. We explicitly disclaim all liability for:

  1. Fines, penalties, or legal action resulting from the User’s failure to comply with DGCA regulations.
  2. Use of our drones for unlawful surveillance, transport of prohibited items, or flight over restricted areas.

SECTION 4: TERMS OF SALE, PRICING & PAYMENT

4.1. Pricing Policy

  • All prices listed on the website are in Indian Rupees (INR).
  • GST: Unless explicitly marked “Excluding GST,” prices typically include Goods and Services Tax. However, the final invoice will clearly breakdown the tax component.
  • Price Volatility: Prices for components dependent on raw materials (like Aluminum, Copper for motors, and Lithium for batteries) are subject to change based on market fluctuations without prior notice.

4.2. Order Acceptance

The receipt of an order number does not constitute the acceptance of an order. Indo Aerial Systems reserves the right to limit the order quantity on any item and/or to refuse service to any customer due to:

  • Stock unavailability.
  • Errors in product or pricing information.
  • Suspicion of fraudulent activity.

SECTION 5: SHIPPING, DELIVERY & RISK OF LOSS

5.1. Shipping Timelines

  • Processing: Standard orders are processed within 24-48 hours of payment confirmation.

  • Logistics: We utilize third-party logistics partners (e.g., Delhivery, DTDC, Blue Dart). Estimated delivery times (usually 3-7 business days) are estimates only and are not guaranteed.

5.2. Risk of Loss

All items purchased from MK Aero are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

  • Damaged Goods: If a package arrives visibly crushed or open, User must refuse delivery and contact us immediately. Acceptance of a damaged package implies the User accepts the condition of the goods.

SECTION 6: EXTENDED WARRANTY & RETURN POLICY

6.1. The "No Crash" Warranty

Due to the nature of aerial robotics, Indo Aerial Systems DOES NOT provide a warranty against damage resulting from:

  • Crashes, collisions, or “hard landings.”
  • Pilot error or loss of orientation.
  • Improper assembly (e.g., loose bolts, bad soldering).
  • Water damage (unless the specific component is IP-rated).

6.2. Manufacturing Defects (Dead-on-Arrival)

We stand by our “Indigenous Engineering” quality. We offer a limited warranty strictly covering Manufacturing Defects under the following conditions:

  • Reporting Window: Defects must be reported within 48 hours of delivery.
  • Evidence: User must provide high-resolution photos/video of the defect before any assembly or soldering has taken place.
  • Replacement: Valid defective parts will be replaced free of cost.

6.3. Non-Returnable Items

For safety and quality assurance, the following items cannot be returned once opened:

  • Batteries: LiPo batteries (due to chemical degradation risks).
  • Electronic Modules: Flight Controllers (FC), ESCs, and PDBs. Once solder is applied to these pads, the warranty is voided immediately as we cannot verify the quality of the soldering equipment used.

SECTION 7: INTELLECTUAL PROPERTY RIGHTS

7.1. Ownership

All content included on this site, such as text, graphics, logos (MK Aero), button icons, images, audio clips, and software, is the property of Indo Aerial Systems Pvt. Ltd..

7.2. Proprietary Designs

The User acknowledges that specific designs, including but not limited to:

  • Ribbed Aluminum Arm Structure;
  • Tank Battery-Protection Profiles;
  • Integrated PDB Layouts; are proprietary innovations of Indo Aerial Systems. Any attempt to reverse-engineer, copy, mold, or reproduce these designs for commercial sale is a violation of intellectual property laws and will be met with legal action.

SECTION 8: LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, INDO AERIAL SYSTEMS PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PRODUCTS;
  2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY;
  3. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Specifically, we are not liable for damage to crops, third-party property, or personal injury caused by the operation of our drones. The User assumes 100% of the risk associated with flight.

SECTION 9: GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of India.

  • Jurisdiction: You agree that any legal action or proceeding between Indo Aerial Systems and you for any purpose concerning these Terms or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Chennai, Tamil Nadu, India.
